Welcome to AI Stylist. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", "your") and AI Stylist ("Company", "we", "us", "our").

By accessing, browsing, or using our Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.

IMPORTANT: These Terms contain provisions that limit our liability and require disputes to be resolved through arbitration. Please read them carefully.

2. Service Description

AI Stylist provides an AI-powered digital fashion analysis service that includes:

• Personal color analysis based on user-uploaded photographs
• AI-generated fashion and outfit recommendations
• AI-generated outfit recommendation images
• Style coordination guidance and tips

Entertainment Purpose: The Service is provided for entertainment and informational purposes only. It does not constitute professional styling, medical, health, or any other professional advice.

AI Limitations: All recommendations are generated by artificial intelligence and may not be accurate, suitable, or appropriate for all individuals. Results may vary.

3. Eligibility and Account Requirements

3.1 Age Requirement

You must be at least 18 years of age to use this Service. By using the Service, you represent and warrant that you are at least 18 years old. We do not knowingly provide services to individuals under 18.

3.2 User Responsibilities

• Provide accurate, current, and complete information
• Maintain the security of your personal data
• Use the Service only for lawful purposes
• Not attempt to circumvent, disable, or interfere with the Service
• Not upload content that infringes on third-party rights
• Not use the Service to generate harmful, offensive, or illegal content

4. Payment Terms and Pricing

4.1 Pricing

• Service fee: $3.99 USD per style analysis report
• This is a one-time payment; no subscription or recurring charges
• Prices are displayed in USD and may be subject to currency conversion by your payment provider

4.2 Payment Processing

• Payments are processed securely through Polar (polar.sh), our Merchant of Record
• We do not store your credit card or payment information
• All transactions are encrypted and PCI-DSS compliant

4.3 Taxes

Prices may or may not include applicable taxes depending on your jurisdiction. Any applicable taxes will be calculated and displayed at checkout.

5. Digital Product Delivery

Upon successful payment verification:

• Your AI analysis will begin automatically
• Your personalized report will be delivered digitally within seconds to minutes
• The report will be displayed directly in your browser
• You may save the report as an image for personal use

No Physical Delivery: This is a 100% digital service. No physical goods are shipped.

6. Intellectual Property Rights

6.1 Our Intellectual Property

The Service, including its original content, features, functionality, design, and underlying technology, is owned by AI Stylist and is protected by international copyright, trademark, and other intellectual property laws.

6.2 Generated Content License

Upon purchase, you are granted a limited, non-exclusive, non-transferable license to use the generated analysis report and images for personal, non-commercial purposes only. You may NOT:

• Redistribute, sell, or sublicense the generated content
• Use the content for commercial purposes without written permission
• Claim ownership of AI-generated content
• Remove any watermarks or attributions

7. User Content and Data

7.1 Your Uploaded Content

By uploading photos or other content to the Service, you:

• Grant us a limited license to process your content solely for providing the Service
• Represent that you own or have rights to the uploaded content
• Represent that the content does not violate any third-party rights
• Acknowledge that uploaded photos are processed in real-time and NOT permanently stored

7.2 Prohibited Content

You agree NOT to upload content that is:

• Illegal, harmful, threatening, abusive, or harassing
• Sexually explicit or pornographic
• Infringing on intellectual property rights
• Depicting minors
• Fraudulent or deceptive

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties regarding accuracy, reliability, or completeness of AI-generated content
• Warranties that the Service will be uninterrupted, secure, or error-free
• Warranties that results will meet your expectations or requirements

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• AI Stylist shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid for the Service ($3.99 USD)
• We are not liable for any damages arising from your use of AI-generated recommendations
• We are not liable for any third-party actions or services

Some jurisdictions do not allow limitations on implied warranties or liability, so these limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless AI Stylist and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you upload or submit

11. Dispute Resolution

11.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at saraintt@gmail.com to attempt informal resolution. We will attempt to resolve disputes within 30 days.

11.2 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to conflict of law principles.

11.3 Jurisdiction

Any disputes not resolved informally shall be subject to the exclusive jurisdiction of the courts in Seoul, Republic of Korea.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after any modifications constitutes acceptance of the updated Terms.

We will make reasonable efforts to notify users of material changes via email or Service notification.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without prior notice, for conduct that we believe:

• Violates these Terms
• Is harmful to other users or third parties
• Is fraudulent or illegal

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and AI Stylist regarding the Service and supersede all prior agreements and understandings.
